These Terms of Service ("Terms") govern your use of ZenesMedia's website and advertising services. By submitting a form, signing an agreement, or engaging our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing this website or engaging ZenesMedia for services, you confirm that you are authorized to act on behalf of the business submitting the inquiry, and that you agree to these Terms in full.

2. Description of Services

ZenesMedia provides paid advertising, ad creative, lead follow-up automation, and appointment booking services exclusively for residential painting companies. Services are delivered through paid social media advertising (including but not limited to Meta platforms), automated SMS and email follow-up, and appointment scheduling support.

3. Eligibility

Our services are intended for owner-operator residential painting companies operating in the United States or Canada. We reserve the right to decline service to any business, including franchises or businesses outside the residential painting industry, at our sole discretion.

4. The Guarantee & Payment Terms

Under our standard engagement, clients are guaranteed 5–15 paying jobs before any service fee is charged. Ad spend (typically $1,500/month, paid directly to the advertising platform) is separate from and not covered by this guarantee. The specific guarantee terms, ad spend amount, and service fee applicable to your account will be confirmed in your individual service agreement, which controls in the event of any conflict with this general description.

Ad spend is billed directly by the advertising platform (e.g., Meta) and is the client's responsibility regardless of results. The monthly service fee (typically $1,000/month) begins only once the guaranteed number of paying jobs has been delivered, as outlined in your service agreement.

5. Term & Termination

Engagements continue on a month-to-month basis following the guarantee period unless otherwise specified in your service agreement. Either party may terminate with written notice as outlined in that agreement. Amounts already owed for ad spend or earned service fees remain due upon termination.

6. Client Responsibilities

Respond to and follow up with leads and booked appointments in a timely manner
Provide accurate business information, service area, and pricing guidance used in ad creative
Maintain the capacity to handle the volume of estimates generated by the campaign
Provide timely feedback and approvals needed to launch or adjust campaigns

Delays in appointment follow-up or estimate delivery on the client's part may affect results and are outside ZenesMedia's control.

7. Advertising Compliance

All ad creative is produced and managed in accordance with the advertising platform's policies. ZenesMedia is not responsible for ad account restrictions or disapprovals resulting from platform policy changes outside our control, though we will work in good faith to resolve any such issues.

8. Intellectual Property

ZenesMedia retains ownership of proprietary systems, templates, and processes used to deliver services. Ad creative produced specifically for a client's campaign may be used by that client for their own marketing purposes following the engagement, unless otherwise agreed in writing.

9. Disclaimers & Limitation of Liability

Outside of the specific paying-jobs guarantee described in your service agreement, ZenesMedia makes no other guarantees regarding advertising performance, lead volume, or revenue outcomes. To the maximum extent permitted by law, ZenesMedia's liability for any claim arising from these Terms or our services is limited to the amount paid by the client in the preceding three months.

10. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the engagement, including pricing structures, ad performance data, and internal processes.

11. Communications & SMS

12. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, unless otherwise specified in an individual service agreement.

13. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
